2. Personalized Products

EtnoArt creates personalized wood-burned artwork based on photographs and information provided by customers.

Every artwork is individually prepared and made specifically for the customer.

Because natural birch wood is used, each piece may vary slightly in wood grain, natural markings, tone and colour.

These natural variations are part of the character of real wood and are not considered defects, provided that the product otherwise conforms to the order and product description.

The finished artwork may also differ slightly from examples shown on our website because every customer photograph and every piece of natural wood is unique.

Wood grain, natural markings and slight colour variations are part of the material’s natural character and contribute to the uniqueness of every artwork.

3. Customer Photos and Personalization

By uploading a photograph, name, date, dedication or other content, you confirm that:

  • You own the necessary rights to the submitted content or have permission to use it.
  • The content does not violate applicable law or third-party rights.
  • The content does not contain unlawful, offensive or otherwise prohibited material.

EtnoArt reserves the right to refuse or cancel orders containing unlawful or inappropriate content.

To prepare your artwork, we may make reasonable adjustments to the uploaded photograph, including cropping, positioning, contrast, tonal adjustments and other changes necessary for artistic preparation and the wood-burning process.

Customer photographs are used only for processing and fulfilling the relevant order unless the customer separately gives permission for another use.

Personal customer photographs and finished personalized artwork will not be published for advertising, social media or other promotional purposes without prior permission.

4. Order Process

The ordering process is as follows:

  1. Choose your artwork and upload your photograph.
  2. If you wish, add names, a date or a personal dedication.
  3. Enter your contact and delivery information.
  4. Complete payment securely using one of the payment methods available at checkout.
  5. Our artist individually prepares and refines your artwork, giving every detail careful attention.
  6. Your personalized artwork is then created on natural birch wood and carefully prepared for shipping.
  7. The finished order is shipped to the delivery address provided by you.

Every artwork is individually prepared and created.

If the uploaded photograph is unsuitable for the requested artwork or if we require additional information, we may contact you using the email address provided with your order.

Customers are responsible for providing accurate contact, delivery and personalization information. Delays caused by incorrect or incomplete information may affect the estimated delivery time.

EtnoArt reserves the right to refuse or cancel an order if the submitted photograph is unsuitable, the order cannot reasonably be fulfilled, or another legitimate reason prevents us from completing it.

If EtnoArt cancels an order after payment and no suitable alternative is agreed with the customer, the amount paid for the cancelled order will be refunded.

5. Prices, Taxes and Payment

All consumer prices are displayed in Euro (€), unless otherwise stated.

The final total amount payable will be clearly displayed before the customer completes the order.

Where required by applicable law, applicable VAT will be calculated as part of the purchasing process and included in the amount payable by the customer.

For eligible consignments imported into the European Union, applicable VAT may be collected and reported through the Import One Stop Shop (IOSS) scheme.

Payment is completed securely using the payment methods available at checkout.

Depending on the customer’s country, device and availability, payment options may include:

  • Credit and debit cards
  • Apple Pay
  • Google Pay
  • PayPal
  • Other payment methods supported by our payment providers

The payment methods actually available to the customer will be displayed at checkout.

Payments are processed securely by third-party payment providers. EtnoArt does not receive or store complete payment-card details.

Where applicable import duties or other mandatory import charges are included in the price or borne by EtnoArt, they will not be charged separately to the customer.

If additional mandatory charges apply to a particular destination or order and cannot be borne by EtnoArt, they will be disclosed before the purchase is completed where such charges are known to us.

Order processing begins following successful payment or payment authorization.

6. Shipping and Delivery

EtnoArt offers free standard shipping to eligible destinations across Europe, unless otherwise stated at checkout.

Most orders are expected to arrive within approximately 10–15 days after successful payment.

Actual delivery times may vary depending on factors including:

  • Destination country
  • Shipping carrier
  • Customs and import procedures
  • Public holidays
  • Incorrect or incomplete delivery information
  • Events outside our reasonable control

We aim to arrange shipments to the European Union in a way that avoids unexpected additional charges for the customer upon delivery.

Where this is not possible for a particular destination or order, known mandatory additional charges will be disclosed before the purchase is completed.

Delivery estimates are provided in good faith and are not guaranteed delivery dates unless expressly agreed otherwise.

Unless another delivery period has been specifically agreed, delivery will take place within the period required by applicable consumer law.

Where EtnoArt arranges the carrier, the risk of loss or damage during transport remains with EtnoArt until the goods are delivered to the customer or another person designated by the customer, to the extent required by applicable law.

7. Personalized Products and Right of Withdrawal

EtnoArt products are made according to the customer’s individual specifications and are clearly personalized.

For this reason, the standard 14-day right of withdrawal that normally applies to distance purchases does not apply to personalized products where the applicable consumer law provides an exception for goods made to the consumer’s specifications or clearly personalized goods.

This does not affect any statutory rights relating to faulty, damaged, incorrectly supplied or otherwise non-conforming products.

If you contact us immediately after placing an order, we will try to accommodate a cancellation where possible, provided that individualized preparation of the artwork has not already begun.

Because personalized preparation may begin shortly after successful payment, cancellation cannot be guaranteed.

Where EtnoArt confirms a cancellation, the applicable refund will normally be returned through the original payment method unless otherwise agreed.

8. Faulty, Damaged or Incorrect Products

Nothing in these Terms limits your mandatory statutory consumer rights.

Where applicable EU consumer law applies, consumer goods benefit from a legal guarantee of conformity of at least two years from delivery. National law may provide additional protection. European Union

If a product is faulty, damaged, materially different from what was ordered, or otherwise does not conform to the contract, you may be entitled under applicable law to remedies including:

  • Repair
  • Replacement
  • Price reduction
  • Refund

The appropriate remedy will depend on the circumstances and applicable consumer law.

If an item appears to have been damaged during shipping, please contact us as soon as reasonably possible and, where possible, provide photographs showing:

  • The damaged artwork
  • The packaging
  • The shipping label

We recommend reporting visible transport damage within 7 days of delivery so that we can investigate the issue promptly with the carrier.

This recommended 7-day reporting period does not limit, replace or remove any statutory consumer rights or legal guarantee rights that apply to your purchase.

Natural wood grain, natural markings and reasonable variations in the colour or tone of natural wood are not, by themselves, considered defects.

9. Intellectual Property

All original content on etnoartstudio.com, including EtnoArt branding, logos, website text, graphics, layouts, designs, product presentations and other original materials, is protected by applicable intellectual-property laws.

Such content may not be copied, reproduced, distributed or commercially used without prior written permission.

Customers retain any rights they hold in photographs and other content they upload.

By submitting content to EtnoArt, the customer grants EtnoArt a limited right to use that content only to the extent reasonably necessary to prepare, create, process and fulfil the relevant order.

Personal customer photographs or completed personalized artwork will not be used for advertising or promotional purposes without the customer’s permission.

10. Privacy and Payment Providers

Personal information is processed in accordance with our Privacy Policy.

To process payments, orders, shipping and other activities necessary to fulfil the purchase contract, personal information may be shared with service providers where necessary.

Where payment is processed by a third-party payment provider, that provider may process payment and transaction information in accordance with its own privacy policy and legal obligations.

For more information about how personal data and uploaded photographs are handled, please review our Privacy Policy.

11. Liability

Nothing in these Terms excludes or limits any liability or consumer right that cannot legally be excluded or limited.

To the extent permitted by applicable law, EtnoArt is not responsible for indirect or unforeseeable losses that are not a direct consequence of a breach of these Terms by EtnoArt.

Nothing in this section limits statutory remedies relating to faulty, damaged, incorrectly supplied or otherwise non-conforming goods.

12. Changes to These Terms

EtnoArt may update these Terms & Conditions from time to time for legal, operational or business reasons.

The Terms applicable to an order are the Terms that were in effect when that order was completed.

Changes made after an order has been concluded do not retroactively alter the terms of that existing contract.

13. Applicable Law and Consumer Rights

These Terms & Conditions are governed by the laws of North Macedonia, except where mandatory applicable law provides otherwise.

If you are a consumer residing in the European Union and EtnoArt directs its commercial activities to your country of residence, this choice of law does not deprive you of mandatory consumer protections that you are entitled to under applicable EU law or the national law applicable to you.

If a problem arises with an order, we encourage you to contact us first so that we can try to resolve the matter directly and fairly.
